AGREEMENT TO OUR LEGAL TERMS

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and 95Network, concerning your access to and use of the Services.

By accessing the Services, you confirm that you have read, understood, and agreed to be bound by these Legal Terms. If you do not agree with all of these Legal Terms, you are prohibited from using the Services and must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are incorporated by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. Updates will be reflected by revising the “Last updated” date. It is your responsibility to review these Legal Terms periodically.

Eligibility and Age Requirements

The Services are intended for users who are at least 18 years old. Services include both publicly accessible content and features that require user interaction, such as account registration, financial transactions, and submission of user-generated content.

Publicly available content, including sermons, videos, articles, and other resources, may be accessed by users of all ages.

However, users must be at least 18 years of age to:

  • Register for an account
  • Make purchases or financial transactions
  • Submit any user-generated content through the Services

By engaging in these activities, you represent and warrant that you are at least 18 years old.

In accordance with the Children’s Online Privacy Protection Act, the Services are not directed to children under the age of 13, and 95Network does not knowingly collect personal information from children under 13. If we become aware that personal information has been collected from a child under 13 without verifiable parental consent, we will take appropriate steps to delete such information.

All products are subject to availability. We reserve the right to discontinue products at any time. Prices are subject to change.

5. PURCHASES AND PAYMENT

All payments shall be made in US dollars.

6. RETURN / REFUNDS POLICY

All sales are final and no refunds will be issued.

7. DONATIONS AND CHARITABLE CONTRIBUTIONS

95Network is a tax-exempt organization under IRC §501(c)(3). Contributions made through the Site are charitable gifts and are not refundable absent extraordinary circumstances at the sole discretion of 95Network. Donors will receive an electronic acknowledgment for contributions of $250 or more as required by the IRS. Recurring gifts may be cancelled at any time by contacting [email protected] prior to the next scheduled processing date. 95Network reserves the right to use gifts in furtherance of its mission, including re-directing restricted gifts where the original purpose becomes impractical, subject to applicable law.

8. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make them available.

As a user of the Services, you agree not to:

  • Systematically retrieve data from the Services to create a collection, database, or directory without permission.
  • Trick, defraud, or mislead us or other users.
  • Circumvent or interfere with security-related features.
  • Disparage or harm the Services.
  • Harass or harm another person using information obtained from the Services.
  • Use the Services in violation of any laws or regulations.
  • Upload viruses, malware, or harmful code.
  • Use automated systems such as bots or scraping tools.
  • Attempt to impersonate another user.
  • Interfere with the operation of the Services.
  • Attempt to bypass access restrictions.
  • Copy or reverse engineer the Services’ software.

Without limiting other provisions of these Legal Terms, we reserve the right to deny access to the Services, including blocking certain IP addresses, to any person for any reason, including violations of these Legal Terms or applicable law.

We may terminate your use of the Services or delete any content you have posted at any time without warning.

If your account is terminated or suspended, you may not register a new account under your name, a fake name, or the name of another person.

We may pursue legal action, including civil or criminal remedies, if necessary.

9. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove content from the Services at any time and for any reason without notice.

We are not obligated to update any information on the Services.

We may experience interruptions due to hardware failures, software issues, or maintenance. As a result, the Services may be unavailable temporarily.

We are not liable for any loss, damage, or inconvenience caused by your inability to access the Services during downtime.

Nothing in these Legal Terms obligates us to maintain, support, or update the Services.

10. GOVERNING LAW

These Legal Terms and your use of the Services are governed by the laws of the State of South Carolina, United States.

11. DISPUTE RESOLUTION

Any legal action shall be brought in the state or federal courts located in South Carolina. Both parties consent to the jurisdiction and venue of these courts.

Any claim related to the Services must be brought within one (1) year after the cause of action arises.

12. DISCLAIMER

The Services are provided “as is” and “as available.” Your use of the Services is at your sole risk.

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not responsible for:

  • Errors or inaccuracies in content
  • Personal injury or property damage
  • Unauthorized access to secure servers
  • Interruptions in transmission
  • Bugs or viruses transmitted through the Services
  • Losses caused by reliance on content

13. LIMITATIONS OF LIABILITY

17. CALIFORNIA USERS AND RESIDENTS

If a complaint is not resolved satisfactorily, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs.

18. MISCELLANEOUS

These Legal Terms constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect.

Failure to enforce any provision does not constitute a waiver of that provision.
